Here are a few of the more frequently asked questions about the mediation process in Washington:
What Are The Benefits Of Mediation?
Mediation and other alternative dispute resolution methods come with many potential benefits:
- First, mediation is generally faster. While litigation can sometimes take many months or even years to resolve, coming to an agreement outside of court is typically a much quicker way to resolve your concerns.
- Second, mediation is often less expensive. You typically don’t have to spend as much on court costs and attorney fees.
- Third, mediation allows for creative resolutions. The court has limited options to offer, but creating your own agreement means that you can develop out-of-the-box solutions. It also puts you back in control of the outcome instead of entrusting your future to an unknown judge.
- Fourth, mediation is less contentious. This is particularly important when children are involved.
Can The Mediator Act As My Attorney, Too?
No, the mediator is required to be a neutral third party, so you have to choose ahead of time which role Roberta Madow or Damon Canfield will play. She or he can either act as your consulting lawyer, assisting you as you work with the mediator, or she or he can act as the actual mediator who facilitates the discussion.
Does The Mediator Make The Ultimate Decision?
No, the mediator only guides the discussion between you and the other party. He or she is not a judge and doesn’t have the final say. You retain full control over the outcome.
How Long Does Mediation Take?
The time it takes to resolve your concerns will depend on the nature of the concerns and how easy it is to come to an acceptable compromise with the other party. It may take one mediation session or several to work out all the details and craft a resolution that works for you.
What If I Need Help Making The Best Decisions?
Mediation doesn’t have to be limited to you, the other party and the mediator. If you want, you can include your attorney, who can provide tailored legal advice throughout the process. Also, you can choose to work with other experts such as child psychologists, forensic accountants, financial planners and others.
